A COMMERCIAL MOTOR VEHICLE is a motor vehicle or a combination of a motor vehicle and one or more other vehicles
  1. used in commerce to transport passengers or property; and
  2. used upon a land highway or vehicular way; and
  3. that
    1. has a gross vehicle weight rating (GVWR)* or gross combination weight rating (GCWR)* greater than 10,000 pounds; or
    2. has seats to transport 9 or more people, including the driver; or
    3. any vehicle displaying a hazardous materials placard (regardless of weight).
*GVWR and GCWR are defined in the instructions for field 95 GVWR/GCWR.

Gross Vehicle Weight Rating > 10,000 lbs.
Gross Vehicle Weight Rating > 10,000 lbs.
Gross Combination Weight Rating > 26,000 lbs.
Gross Combination Weight Rating > 26,000 lbs.

The following vehicle, although used in commerce, should not be recorded in this section, as its Gross Vehicle Weight Rating is less than 10,000 lbs.:

Not a Commercial Vehicle
Not a commercial vehicle

Farm vehicles hauling produce to and from market are considered commercial motor vehicles if they meet the criteria in (A) to (C).
